  1. License Agreement, Disclaimer of Warranty (1. to 5.)

  4. Daniel Taverney, product author and owner is defined as 'the Author'
  5.  
  6. By using the Software, in whole or in part, you agree to be bound
  7. by the terms of this Agreement. If you do not fully agree to or clearly
  8. understand all the terms of this Agreement, remove the Software and
  9. all its accompanying files from your machine and any archival device
  10. and discard any file and/or media you might have, which supported
  11. its distribution.

  13. 1. Limited License
  14.  
  15. The Author grants you a non-exclusive, non-transferable license to install
  16. and use the Software in a single location on a hard disk or other storage
  17. device, under the following conditions:

  19. Free, unregistered version

  21. This version is for private use only. Under this condition, the Software is
  22. freely usable, the only restriction being the internal limit of 15 elements
  23. per menu. Unlimited menu chaining is possible.
  24.  
  25. Note that installation in a professional environment or use of the Software
  26. for professional purposes requires the user to obtain a license and pay the
  27. required fee. Commercialization of HTML files generated by the program is
  28. considered as professional usage for which registration is required.

  30. Registered version
  31. ==================
  32. Payment of a single license fee entitles the licensee (and only she/he) to
  33. use the Software in a professional environment and to use the files generated
  34. by the program for commercial/professional purposes. Registration will eliminate
  35. the limit of 15 elements per menu.
  36.  
  37. When the Software is installed on a FILE SERVER FOR USE ON A NETWORK
  38. BY MULTIPLE USERS, the licensee must request and pay for as many licenses
  39. as the number of users authorized to run the Software through the network. Note
  40. that usage of the HTML files generated by WinToWeb is not considered as
  41. 'running the Software'.

  43. 2. Distribution
  44. ===============

  46. Small scale distribution (to family, friends etc.):
  47. ---------------------------------------------------
  48. You can freely distribute the unregistered version of WinToWeb under its
  49. archive form (Zip) as downloaded from our Web site or other authorized remote
  50. sites. You are not allowed to modify any file contained in the archive.

  52. Large scale distribution (Web sites, CD, Magazines etc.)
  53. --------------------------------------------------------
  54. In order for us to keep track, to provide you with the latest version and to
  55. get ready to offer reliable support to users, please contact us prior to:
  56.  
  57. - providing download of WinToWeb from a Web site, BBS or any remote access mean
  58.   (applicable unless the Author himself posted the program for download on the
  59.   concerned site).
  60.  
  61. - including WinToWeb on any support distributed by itself, bundled with a magazine,
  62.   other software package etc.
  63.  
  64. - Mass distributing WinToWeb by any other means.
  65.

  74. 3. Restrictions
  75. ===============
  76. You shall not:

  78. - attempt to reverse engineer, decompile, translate, modify, etc. any part 
  79. or any component of the Software in any manner and for any purpose.
  80. This also applies to non-binary files such as help, tutorials and other files
  81. shipped with WinToWeb. 
  82.  
  83. - remove or obscure the Author's proprietary notices, copyright, trademark
  84. or legends contained within the Software itself or in any of its accompanying 
  85. files.

  87. - Communicate to anyone or make publicly available registration codes and
  88. keys or any other scheme that would fake legal  registration, such permitting
  89. unlimited use of the Software.

  91. 4. DISCLAIMER OF WARRANTY (All versions)

  94. WinToWeb SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY 
  95. OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT 
  96. LIMITATION, ANY WARRANTY OF MERCHANTABILITY AND FITNESS 
  97. FOR A PARTICULAR PURPOSE.

  99. IN NO EVENT SHALL THE AUTHOR, HIS AUTHORIZED DISTRIBUTORS OR
  100. LICENSORS BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL OR
  101. CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY
  102. TO USE THE SOFTWARE OR THE MEDIA, EVEN IF THE AUTHOR, HIS
  103. AUTHORIZED DISTRIBUTORS OR LICENSORS HAVE BEEN INFORMED
  104. OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING.

  110. THE COSTS OF RECOVERING SOFTWARE, THE MEDIA, DATA OR
  111. EQUIPMENT, THE COST OF SUBSTITUTE SOFTWARE OR THE MEDIA, 
  112. DATA OR EQUIPMENT OR CLAIMS BY THIRD PARTIES, OR OTHER SIMILAR
  113. COSTS. LEGAL DOMICILE: LAUSANNE/SWITZERLAND.

  115. DISCLAIMERS, LICENSE AGREEMENTS AND COPYRIGHTS OF THIRD
  116. PARTY'S SOFTWARE AND/OR CODE FRAGMENTS DISTRIBUTED WITH
  117. WinToWeb ARE PROVIDED BY EACH CONCERNED PARTY AND ARE 
  118. APPLICABLE INDEPENDENTLY OF THESE SOFTWARE AND/OR CODE 
  119. FRAGMENTS BEING USED WITHIN OR OUTSIDE OF THE WinToWeb 
  120. ENVIRONMENT.
